Germany: Federal Office of Justice takes action against Telegram

All social network-users shall be able to file for complain in case the recognize content punishable by law. This is stipulated in the NetzDG.  The messenger service Telegram had problems fulfilling these requirements.

„What is Telegram actually?

Telegram is a free instant messaging service for the use on smartphones, tablets, smartwatches and PCs, developed in Russia.Telegram users can exchange text messages, voice messages, photos, videos and documents, as well as use voice and video calling to other Telegram users. According to its own information, the base of the development team is in Dubai, but no imprint is given on the website. It is common to read on the internet that the Telegram Crew is a digital nomad crew, but no statement has been made from the actual company yet.

According to different German Newspapers, the Federal Ministry of Justice (BMJV) is taking action against the messenger service Telegram. The reason was that options for complaining about criminal content were not easily recognisable and accessible. However, this is required by the Network Enforcement Act (NetzDG).

In addition, it is still not clear where Telegram’s courts could be if someone took legal action against the company. Which principle of Territoriality shall apply?

According to the latest statements, the Federal Office of Justice, which is part of the Ministry of Justice, is  is conducting two fine proceedings in the matter.
